When Should a Personal Injury Case go to Trial?

Many times, a client will ask me whether I think their personal injury case is going to go to trial. Or will there be a settlement? Of course, the answer to that question is unique to each case.

I always aim to do what is best for each client in each particular case. Sometimes, that means taking a settlement other times it means going to trial. A big insurance company may be wrong in its evaluation. As a result, make an inadequate settlement offer that is not worthwhile for the client to accept.

In every case, I seek to put my client in the best possible position and to know all the facts and laws of the case honestly. In my opinion, the most important part of a case is the factual development.

Personal Injury Case Verdict

In one motor vehicle crash case that I tried in Greenville SC, in 2021, Allstate, a major automobile insurance company, offered my client only $60,000.00 to settle her case. Despite my client having suffered a brain injury/condition called intracranial hypertension, Allstate did not believe that the wreck caused my client’s injury.

However, at trial, the medical testimony showed otherwise. The Greenville County jury found in my client’s favor in the amount of $150,000.00, which was $90,000.00 more than what Allstate was willing to pay in a settlement. So, my client beat the insurance company’s offer by $90,000.00.

That’s a good day in court if you ask me.

To settle or not – who decides

So each case is unique and my client’s success in her case, is not a guarantee that you will be successful in your case. Each case is different.

I aim to develop each client’s unique facts and circumstances. Then negotiate the case based on my evaluation, considering the risks of trial, the expense of trial, and the time it takes to get to a trial. Even if it means the client should turn down the insurance company’s offer.

One last crucial thing. Who decides whether the client should take a settlement offer or reject an offer and go to trial? The client.

The client has the sole authority to accept, reject, or even make a settlement offer. Of course, every client should listen to the advice of his or her lawyer in making these decisions. But ultimately, it’s up to the client. After all, it’s the client’s case.
