Case Results

Fatal Wrongful Death Car Wreck settlement

Tom represented the estate of a client who was a beloved wife, mother, and grandmother. She was tragically killed in a car wreck due to the negligence of another driver. The case involved an investigation into the at-fault driver running a stop sign and hitting and killing our client who was on her way home from work in her car.

Medical Malpractice Birth Injury settlement

We recently represented a family in a case involving medical malpractice in the labor and delivery room that left our client, now a young child, with a permanent brain injury, and cerebral palsy. We reached a confidential seven-figure settlement for our client.

Medical malpractice wrongful death unrecognized bowel perforation case

Our firm represented a family whose loved one died while an inpatient at the hospital after the doctors and nurses failed to recognize the loved one had a bowel perforation.

Bile duct injury during gall bladder removal surgery

In this case, we represented a client in a case against a surgeon who injured a bile duct while removing our client’s gall bladder due to a lack of an adequate view of the anatomy during the laparoscopic procedure.

Apartment security assault case

We represented a client against an apartment complex owner and the management company for failing to prevent an intruder’s attack on our client when the apartment complex knew or should have known the intruder was present on the apartment premises illegally.

The apartment complex had a near-term history of serious violent crime occurring on its premises as well as weak, inadequate security measures.

Motorcycle wreck leading to shoulder injury and surgery

We represented a client in a motorcycle crash case that left our client with a serious shoulder injury requiring surgery. A truck pulling a trailer with lawn equipment suddenly pulled out in front of our client who was keeping a proper lookout, causing our client to crash into the truck.

Pharmacy error leading to hospitalization

We represented a client in a case against a major pharmaceutical retail chain when the pharmacist filled a prescription that was contraindicated in our client, leading to hospitalization of our client for excessive bleeding.

Medical malpractice medication injury to child settlement

We recently settled a case against medical providers for an infant who was given too much of a powerful antibiotic called Gentamicin, which resulted in permanent hearing loss for the child. The settlement was confidential.

Medical malpractice wrongful death settlement

We recently reached a settlement involving a nurse failing to supervise a patient who fell at a hospital and suffered a brain injury that led to his death. The settlement was confidential.

Dangerous premises – school cafeteria

We recently settled a case involving a school cafeteria failing to clean up spilled water on the floor after having constructive notice of the water on the floor. This caused our client, a middle school student, to slip and break her ankle. Our client required hardware implantation in her ankle including a plate and screws. She continued to have ankle swelling with activity after the surgical procedure and her treatment were finished.

Jury Trial

In one of the first post-pandemic jury trials held in Greenville County, Tom served as sole trial counsel for our client, resulting in the jury returning a verdict in favor of our client for $150,000.00. The case involved a motor vehicle crash involving a car and a motorcycle. Our client was the passenger on a motorcycle when the at-fault driver pulled out in front of the motorcycle. Our client sustained numerous injuries that required hospitalization and medical treatments.

Medical Malpractice Settlement

We represented a patient in a medical malpractice case involving a retained foreign object left behind after surgery. Our client underwent a surgical procedure. After the procedure, she developed an infection that would not resolve.

Eventually, an exploratory procedure was performed to understand the source of the client’s infection. During that exploratory procedure, a roll of gauze was discovered. It was later determined that the gauze had been left behind after the first surgical procedure.

The case was settled without litigation.

Trucking Crash Accident Settlement

We represented the driver of a vehicle struck by a tractor-trailer on I-85 in Anderson County. The collision set off a chain reaction, resulting in a multi-vehicle crash.

We obtained a settlement without filing a suit against the tractor-trailer owner because he failed to pay attention.

Commercial Vehicle Accident

We resolved a motor vehicle accident case against a commercial entity in which the driver of the commercial vehicle ran a stop sign and slammed into our client’s vehicle causing our client serious injuries, including numerous fractures.

Trucking case involving a motorcycle collision. 

This case involved the loss of life of a young man who was riding a motorcycle that was in a crash with a commercial truck. Drunk driving accidents

We have handled numerous cases against drunk drivers causing accidents that injured our clients, including a drunk driver running a red light and crashing into our client, causing severe injuries.

Mr. Creech represented the family of a passenger who died in a car wreck against the driver of the car who was intoxicated and crashed the car, killing our client.

Medical malpractice: birth injury

In a case against various medical providers, we represented the family of a man who died suddenly as a result of blood clots that traveled to his lungs and killed him.

Premises Liability: Unsafe Entry/Exit

In a premises liability case settlement, we alleged that a building owner failed to upgrade or make safe an exit door landing platform that caused our client to fall and fracture her ankle, requiring surgery and hardware implantation and permanent impairment.

Premises liability: Severe brain injury case

Mr. Creech represented the family of a man who was attacked at a bar and suffered serious brain injuries when his head hit a cement floor at the bar. Premises liability case requiring surgery

Mr. Creech represented a woman who was shopping at a grocery establishment when she stepped on a folded box, causing her to slip, fall, and tear a rotator cuff, requiring surgery. A store employee placed the folded box on the floor and hid it from our client as she rounded a corner of a bin.

Medical malpractice above the knee leg amputation

In a medical malpractice case, we represented a patient who developed a preventable condition called compartment syndrome that led to the amputation of the patient’s leg.

Moped accident requiring extensive hospitalization

Our client was riding his moped, wearing a helmet and a reflective safety vest when suddenly another car turned left in front of our client, hitting our client, and causing our client severe injuries, requiring extensive hospitalization.

Guardrail case wrongful death

We represented a mother whose daughter was killed in an accident when the daughter’s car left the roadway. Our case was against a state agency involving the lack of a guardrail on the side of a road.

Unsafe roadside case

We represented our client against a state agency involving a collision with an electrical guy wire that was located within the clear zone by a paved roadway. Our client suffered a severe brain injury.

Car wreck case involving fractures

We represented our client in a case in which our client suffered numerous fractures, including a fractured femur after having been involved in a wreck with another driver who crossed a center line and hit our client head-on. Mr. Creech represented a man using an e-cig device when the lithium battery exploded in our client’s pocket causing severe burns to our client’s legs and groin area.

False arrest against a Sheriff’s Office

We represented a client who was wrongfully arrested for burglary. Although our client was never at the location of the alleged crime, he was arrested and spent 45 days in jail. We brought claims against a sheriff’s office for false arrest and imprisonment. We have also represented numerous clients in false arrest claims.

Burn Injury to Child

Our law firm represented the family of a young child who received serious burn injuries after being exposed to excessively hot water in an apartment complex. Our case investigation against the apartment complex revealed that the water heater was in a setting that provided water in the apartment at dangerously hot levels.

Medical Malpractice Leading to Wrongful Death

We recently resolved a wrongful death case caused by medical malpractice involving medical providers who failed to remove a mucus plug from a patient’s trachea tube, which led to the patient’s being deprived of oxygen, causing anoxic brain injury and subsequent death.
