Anytime a life is lost in a car accident, it is a tragedy for all involved and especially for the family of the deceased. South Carolina law allows for certain family members to bring a claim for wrongful death of a family member. A wrongful death action is a civil action that is brought on behalf of certain heirs of a deceased loved one after a death has been brought about as a result of wrongful illegal actions by another person or business causing the death of a deceased person, such as negligence. South Carolina law allows the Estate of the deceased, as represented by a properly appointed personal representative, to bring an action for wrongful death. South Carolina law allows for certain family members to be compensated for the loss of companionship, sorrow, grief, loss of support, and other elements of loss. The law spells out which family members are to be compensated.
