As a trial lawyer, I’m comfortable in the courtroom speaking to juries. I “grew up” in the courtroom, first as a law clerk to a judge and then as a prosecutor, representing the State of South Carolina in criminal cases. Trying cases is like riding a bike-you never forget how to do it.
I always aim to do what is best for each client in each particular case. Sometimes, that means taking a settlement other times it means going to trial. A big insurance company may be wrong in its evaluation. As a result, the insurance company might make an inadequate settlement offer that is not worthwhile for the client to accept.
Just recently, I tried a motor vehicle crash case after my client said no to a settlement offer from a major automobile insurance company: Allstate. The jury awarded my client more than double what Allstate offered him. That’s a good day in court if you ask me.
Each case is unique and my client’s success in this case is not a guarantee that you will be successful in your case.
We aim to develop each client’s unique facts and circumstances. Then, negotiate the case based on our evaluation, considering the risks, expenses, and the time it takes to get to a trial… even if it means the client should turn down the insurance company’s offer.
One last crucial thing. Who decides whether the client should take a settlement offer or reject an offer and go to trial? The client. As the client, you have the sole authority to accept, reject, or even make a settlement offer. Of course, every client should listen to the advice of his or her lawyer when making these decisions. But ultimately, it’s up to the client. After all, it’s the client’s case.
