Recent Changes to South Carolina Golf Cart Laws

On May 22, 2025, Governor Henry McMaster signed a new bill that introduced several key updates to golf cart regulations, effective immediately.

Child Safety and Seatbelt Requirements

One of the most significant changes affects families with young children. Under the new law, all children under the age of 12 must wear a seatbelt while riding in a golf cart. This update follows a rise in injuries involving minors due to limited safety measures. Golf carts may still be operated with a permit during daylight hours on public roads where the speed limit is 35 mph or less.

Local Control and Distance Limits

Previously, golf cart use was limited to within four miles of the registered address or within gated communities. Now, municipalities and counties are permitted to establish their own distance limits and operational guidelines. For example, Greenville County has maintained the four-mile restriction; however, this may vary in other areas.

Public Highway Requirements

In addition to holding a valid driver’s license, golf cart operators must follow these guidelines:

Local Governments May:

  • Set hours, methods, and locations of use by ordinance
  • Permit nighttime operation if the cart is equipped with working lights
  • Create dedicated golf cart paths
  • Cannot require proof of property ownership or rental for legal operation
  • Ensure operations are limited to roads with speed limits of 35 mph or less

In Areas Without Local Ordinances:

  • Golf carts may only be operated during daylight hours
  • Use is restricted to secondary roads (speed limit ≤35 mph)
  • Must remain within four miles of the registered address or gated community
  • May cross roads with higher speed limits at intersections only
